Revisions to the Texas T-47 Survey Affidavit and Introduction of New T47.1 Form
The Texas Department of Insurance (“TDI”) revised the T-47 Survey Affidavit, by adding the date of the survey right under the description of the transaction. This change was made to remove the confusion as to whether the owner was certifying to the date of the survey or the date they purchased the property. There is also a change in paragraph 4 which now states “To the best of my knowledge and belief, since Date of the Survey, there have been no: (lists “a” through “d”)” to which the Seller should read thoroughly to make sure the items listed have not been made to the property since the date of the survey.
There is also a new form in the works which would be able to be used by the owner in lieu of the T47 Affidavit at the time of contract (the T47.1). Although it has been approved by TDI, the TREC contracts have not been updated to reflect the new language. The new form differs from the T47 Survey Affidavit as it does not require a notary, however the seller(s) will be required to enter their date of birth along with their current address.
