T-47 Affidavit Texas: Everything You Need to Know
The T-47 Residential Real Property Affidavit (T-47 Affidavit) is a notarized document used in Texas real estate transactions. It is typically required when a seller provides an existing survey of the property instead of ordering a new survey. The T-47 tells the buyer what the seller knows about the property’s boundaries.
The survey date is critical in paragraph 4 of the T-47 Affidavit for several reasons:
1. Accuracy of the Survey: The survey date establishes the timeframe when the property lines, structures, and improvements were last documented and ensures that the existing survey accurately reflects the current state of the property.
2. Verifying Changes: The survey date allows the seller to affirm that no changes or improvements have been made to the property since that time. If changes have occurred, the seller must disclose those modifications on the T-47 Affidavit. If there are no changes, the seller must write “none” in the space provided. This disclosure is necessary to ensure the validity of the survey for the transaction.
3. Title Insurance Requirements: The purpose of the T-47 Affidavit is to assure the buyer, lender, and title company that the information on the existing survey remains accurate and that there have been no significant changes to the property, such as additions, modifications to structures, or boundary alterations since the date of the survey. Heritage Title Company requires the T-47 Affidavit to determine if we can accept the existing survey for the transaction or if we will require a new survey for policy issuance.
